This Privacy Policy describes how SOLD Now LLC, a Texas limited liability company ("SOLD Now," "we", "us", "our", or the "Company"), collects, stores, uses, and safeguards information when you ("User", "Subscriber", or "Reseller") register an account and utilize the SOLD Now software application, diagnostic utilities, and related services (collectively, the "Platform", "SOLD Now", "Service").

Because SOLD Now is an internal business tool designed for independent antique dealers, collectibles and vintage resellers, and inventory managers, this policy applies to data we collect directly from you regarding your business and operations. SOLD Now is a business-to-business (B2B) application and does not directly interact with or independently collect data from your end-consumers. The Service is offered to businesses and individuals located in the United States only.

1. Information We Collect

We limit data processing exclusively to items necessary to provide administrative, inventory tracking, and CRM functionalities to you. We collect data in the following categories:

1.1. Account Registration and Contact Data

When you subscribe to an account tier, we collect standard business credentials including your full name, primary email address, business name, physical location/shop name, and corporate billing details. To enable account verification, two-factor security protocols, and platform alerts, we also collect your corporate or personal phone numbers. Payment card details are collected and processed directly by our third-party payment processor; SOLD Now LLC does not receive or store full payment card numbers.

1.2. Internal Business Content and Inventory Logs

Data you explicitly input into the application to run your business remains within your isolated data silo. This includes: item descriptions, pricing records, historical cost values, inventory images, vendor tracking information, and logs detailing sourcing trips or procurement expenses.

1.3. Customer Relationship Management (CRM) Data

You may use SOLD Now to organize files regarding your customer base, including customer contact lists, transaction records, item preferences, and notification notes. You represent that you have acquired all necessary consents to input this information into our infrastructure.

1.4. Operational and Usage Metrics

We automatically collect basic diagnostics, server log activities, browser specifications, and usage timestamps when you log in. This data is leveraged strictly to ensure system performance, patch system errors, and maintain domain performance. The Platform uses essential cookies required for login sessions and security, and may use analytics tools to understand aggregate feature usage. We do not use cookies for third-party advertising.

2. How We Use Your Information

We process your data exclusively to maintain your account and perform our contract with you. Specifically, we use your data to:

2.1. Transactional Communications

By registering an account, you agree to receive transactional and administrative communications via email. These include payment receipts, renewal and billing notices, security and password recovery messages, system status updates, and data deletion warnings. These communications are a necessary part of operating your account and are not marketing.

Providing a mobile number does not, by itself, enroll you in any text messaging program. We send text messages only to numbers whose owner has separately and affirmatively opted in through an unchecked consent box, and only for the message categories that box describes. See Section 2.2.

2.2. Marketing Communications (Separate Opt-In)

We send marketing communications — such as newsletters, feature announcements, and promotional offers — only if you separately opt in. Consent to receive marketing email or marketing text messages is optional, is requested through a separate, unchecked opt-in at registration or in your account settings, and is not a condition of purchasing or using the Service. You may withdraw marketing consent at any time as described in Section 8. Marketing text messages are sent only with your prior express written consent as required by the Telephone Consumer Protection Act (TCPA); message and data rates may apply, and you can reply STOP at any time.

2.3. Artificial Intelligence Processing Disclosure

Certain optional features transmit the content you submit to third-party artificial intelligence service providers for processing. The providers we engage are identified in Annex A.2 of our Data Processing Addendum.

We do not permit these providers to train on your content. We engage every AI provider under paid commercial API terms that prohibit the use of submitted content to train or improve that provider's models. We do not use consumer or free service tiers, whose terms may permit training. We will update this disclosure if our agreements with AI providers materially change.

The features that transmit content, and what each sends, are:

We keep a log of the prompt text sent by each AI feature, and the assistant's reply, inside your own account, where you can review it. That log is your data and is deleted on the timeline in Section 5.

Mobile phone numbers, SMS opt-in data, and consumer text-messaging consent are never submitted to any AI provider.

2.4. SMS / Text Messaging Program and Mobile Consent

SOLD Now operates text messaging (SMS) programs through Twilio. Two distinct groups may receive text messages, and each provides its own express opt-in:

For all SMS programs: message frequency varies, message and data rates may apply, you can reply HELP for help, and you can reply STOP at any time to cancel and stop receiving further messages. Carriers are not liable for delayed or undelivered messages.

No mobile information is shared with third parties. We do not sell, rent, trade, or share mobile phone numbers, SMS opt-in data, or consumer consent with any third parties or affiliates for their own marketing or promotional purposes. Mobile opt-in information is used solely to deliver the messages you (or, for mailing-list subscribers, the Reseller you subscribed to) requested, and is shared only with the messaging service providers (such as Twilio) strictly necessary to transmit those messages on our behalf. This no-sharing commitment applies to all categories of text messaging described in this Section.

3. Sharing and Disclosing Your Information

We prioritize the confidentiality of your commercial records. We do not sell, rent, trade, or share your operational records, customer databases, phone numbers, email addresses, mobile/SMS opt-in data, or inventory details with any third parties or affiliates for their own marketing or promotional purposes. We engage data only under the following strict conditions:

Mobile and SMS information is never shared. As stated in Section 2.4, mobile phone numbers, SMS opt-in data, and consumer text-messaging consent are never sold, rented, traded, or shared with any third party or affiliate for any purpose other than transmitting the messages you (or the Reseller you subscribed to) requested, and are disclosed only to the messaging carrier/service provider (such as Twilio) strictly required to deliver those messages. No mobile opt-in data is ever shared with AI providers.

4. Separate Multi-Account Security Architecture

As defined in our Terms of Service, Subscribers may establish completely distinct accounts to manage individual booths, locations, or business divisions. Every account is maintained as a strictly separate data silo with isolated database parameters. Information from one account cannot be indexed, queried, or accessed by any other account, and no overarching organizational hierarchy shares data between profiles.

5. Data Portability, Retention, and Deletion Policy

You maintain ultimate operational ownership of your inventory manifests and customer lists. We adhere to the following timelines to ensure secure data handling:

We enforce industry-standard security architectures to prevent data exposure, theft, or manipulation. These measures include HTTPS transport encryption, firewall partitions, and secure access tokens. However, no data transmission across the web can be guaranteed perfectly safe; you maintain responsibility for ensuring robust, unique password configurations for your profiles. In the event of a security breach affecting your sensitive personal information, we will notify affected Subscribers without unreasonable delay, consistent with the timelines required by Texas law and other applicable state breach notification statutes.

7. Children's Privacy

The Service is tailored strictly for adult business operators and professional resellers. We do not knowingly index or track records belonging to individuals under the age of eighteen (18). If we find that an account contains personal files of a minor, we will purge those files immediately.

8. Opt-Out and Communication Preferences

If you no longer wish to receive marketing newsletters or promotional updates via email, you may click the "Unsubscribe" link embedded at the footer of our marketing emails. If you have opted in to any SMS program, you can reply with the word "STOP" at any time to immediately terminate text alerts, or change either SMS consent in Settings → Reseller → SOLD Communications. Replying STOP cancels all text messages from that program, service messages included; account and billing notices then reach you by email instead. Please note that even if you opt out of every text and marketing distribution path, you will continue to receive by email the critical administrative alerts, subscription invoices, password recovery updates, and data deletion warning logs essential to the management of your software license.

9. Your Privacy Rights

You may request access to, correction of, deletion of, or a portable copy of the personal information we hold about you and your account at any time by emailing info@soldnow.app from the email address associated with your account. We will verify your identity and respond within forty-five (45) days. Deletion requests are subject to the Legal Retention Carve-Out in Section 5. We will not discriminate against you for exercising any of these rights.

10. Amendments to This Policy

We reserve the right to modify or adjust this Privacy Policy as our business practices scale. We execute changes by updating the web link text directly on our website. For any material adjustments affecting how your operational data is saved or processed, we will issue a prominent platform warning or deliver an email notification thirty (30) days before the changes go into effect. Continued usage of SOLD Now after updates are published establishes clear consent to the revised policies.
